Please read these Terms and Conditions (“Terms”) carefully before downloading, installing, or using the Dosty Walks mobile application (“App”). By accessing or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.
These Terms constitute a legally binding agreement between you (“User”, “you”) and SIA Dosty, a company incorporated in Latvia (“Company”, “we”, “us”, “our”), in respect of your use of the Dosty Walks application, which is currently operated exclusively in Azerbaijan.
1. Definitions
The following definitions apply throughout these Terms:
- “App” means the Dosty Walks mobile application available on iOS and Android platforms.
- “Account” means the personal account you create to access the App's features.
- “Steps” means the physical step count recorded by your device or connected health platforms and used within the App.
- “Coins / Crystals” means the in-App virtual currency earned by accumulating Steps.
- “Donation” means the voluntary conversion of Coins into community food contributions for animal shelters.
- “Season Pass” means the 90-day milestone-based progression system within the App.
- “Partner Offer” means a discount code or promotional reward provided by a third-party partner and unlocked through Season Pass milestones.
- “Subscription” means a paid in-App plan that expands donation capacity and unlocks additional features.
- “Content” means any text, graphics, images, data, or other material made available through the App.
2. Eligibility
To use the App you must:
- Be at least 13 years of age. Users between 13 and 17 must have the consent of a parent or legal guardian.
- Provide accurate, current, and complete information during registration.
- Have the legal capacity to enter into a binding contract in your jurisdiction.
If you are between 13 and 17 years of age, your parent or legal guardian must read and agree to these Terms before you use the App. By permitting a Minor to register for or use the App, the parent or legal guardian: (a) confirms they have read and understood these Terms; (b) agrees to these Terms on the Minor's behalf; and (c) accepts full responsibility for the Minor's use of the App, including any activity, conduct, or in-App purchases made through the Minor's account. Under Azerbaijani law, minors under the age of 18 do not have full legal capacity to enter into contracts independently, and the Company relies on the parent or guardian's acceptance of these Terms as the binding agreement.
The App is currently offered exclusively to users in Azerbaijan. We make no representation that the App is appropriate or available in any other jurisdiction. Access from other territories is at your own risk and subject to local law.
3. Account Registration
3.1 Creating an Account
Registration requires a valid mobile phone number. Verification is completed via SMS or WhatsApp. You must provide your first and last name, date of birth, gender, and a unique nickname. Optionally, you may add a profile photo and pet information.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account and for all activities that occur under it. You agree to:
- Keep your login credentials secure and not share them with third parties.
- Notify us immediately at support@dosty.co if you suspect unauthorised access to your account.
- Ensure that your account information remains accurate and up to date.
3.3 One Account Per User
Each user may maintain only one active account. Creating multiple accounts to gain unfair advantages in leaderboards, donate more than permitted limits, or circumvent any restrictions is strictly prohibited and may result in account suspension or termination.
4. App Features and How They Work
4.1 Step Tracking
The App records your daily step count via third-party health integrations including Apple Health, Google Fit, Samsung Health, and Android activity sensors. Steps are synchronised every six hours or when the App is opened. Steps are saved locally and uploaded to our servers to protect against data loss.
Manual step input and steps detected as fraudulent by our systems will be filtered out. We do not guarantee the accuracy of step data, which depends on your device hardware and the permissions you grant.
4.2 Coins and Virtual Currency
Steps are automatically converted into Coins at a ratio determined by the Company (currently 1,000 Steps = 1 Coin). This ratio may be adjusted by us from time to time with notice provided in the App. Coins have no monetary value, are non-transferable, and cannot be redeemed for cash or exchanged outside the App.
4.3 Community Donation Goal
Users may convert their Coins into contributions towards a periodic community goal of donating pet food to animal shelters. The community goal target and the Coin-to-food conversion ratio are determined by the Company and are subject to change at any time; the current figures are displayed within the App. Minimum and maximum donation limits apply per user per period, depending on your subscription status.
Donations are irreversible once made. The Company will publish periodic reports within the App showing total contributions and photographic evidence of food deliveries to shelters.
4.4 Season Pass
The Season Pass is a 90-day progression system consisting of approximately 30 cumulative step milestones across three chapters of increasing difficulty. Reaching a milestone automatically unlocks a reward. One Season is active at a time.
Rewards include Partner Offers (discount codes from third-party partners) and other in-App benefits. Partner Offers are subject to the terms and conditions of the respective partner and may expire. The Company is not responsible for the availability, accuracy, or fulfilment of third-party Partner Offers. Certain rewards within the Season Pass are subject to limited availability and may only be claimed by a fixed number of users. Once the maximum claim limit for a reward is reached, that reward will no longer be available to users who subsequently reach the corresponding milestone. The Company accepts no liability for a user's inability to claim a reward that has been exhausted by prior claimants.
4.5 Leaderboard
The App features a country-wide leaderboard (ranking all users within Azerbaijan) and a friends-only leaderboard, ranked by daily, weekly, monthly, and yearly step counts. Users reaching the top three positions in the monthly country-wide leaderboard will receive special medals visible to other users. The Company reserves the right to remove users from the leaderboard who are found to be manipulating step data. Leaderboard positions are updated each time the user opens the App. Steps accumulated while the App is closed will be synchronised and reflected in the leaderboard upon the next App session. The Company does not guarantee real-time ranking updates and accepts no liability for any delay in leaderboard position changes between App sessions.
5. In-App Purchases and Subscriptions
5.1 Subscription Plans
The App offers optional paid subscription plans that increase donation limits and may unlock additional features. Subscriptions are billed through your device's app store (Apple App Store or Google Play Store) and are subject to the respective store's payment terms.
5.2 Billing and Renewal
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You may manage and cancel subscriptions through your app store account settings. We do not process subscription payments directly; all billing is handled by the relevant app store.
5.3 Refunds
Refund requests are subject to the refund policy of the Apple App Store or Google Play Store, as applicable. The Company does not issue direct refunds for in-App purchases except where required by applicable law.
5.4 Price Changes
We reserve the right to change subscription prices at any time. Price changes will be notified to you in advance. Continued use of a subscription after a price change constitutes acceptance of the new price.
5.5 Virtual Currency — No Cash Value
Coins and any other virtual items in the App are not real currency, hold no monetary value, and cannot be transferred, sold, exchanged for cash, or redeemed outside the App. Virtual items may be modified, removed, or discontinued at any time at our sole discretion.
6. User Conduct
You agree not to:
- Use the App in any manner that is unlawful, fraudulent, deceptive, or harmful.
- Manipulate, falsify, or artificially inflate your step count through any means, including scripts, physical manipulation of devices, or use of third-party software.
- Create multiple accounts, impersonate another person, or misrepresent your identity.
- Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App.
- Interfere with or disrupt the App's servers, networks, or security systems.
- Transmit any viruses, malware, or other harmful code.
- Collect or harvest personal data of other users without their consent.
- Use the App for commercial purposes without our prior written consent.
- Post, transmit, or share content that is defamatory, obscene, offensive, or that infringes the rights of any third party.
Violation of these rules may result in immediate suspension or termination of your account without notice and may be reported to relevant authorities.
7. Health and Fitness Disclaimer
Dosty Walks is designed as a motivational fitness tool and is NOT a medical device or health monitoring service. The App does not provide medical advice, diagnoses, or treatment.
Before beginning any new physical activity programme, including walking goals set within the App, you should consult a qualified healthcare professional, particularly if you have any existing medical conditions or have been physically inactive. The Company accepts no liability for any injury, illness, or health consequences arising from the use of the App or participation in activities promoted within it.
Step and calorie data provided by the App are estimates only and may vary significantly from actual values.
8. Privacy and Data
8.1 Privacy Policy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection, use, and processing of your personal data as described in the Privacy Policy.
8.2 Data We Collect
We collect personal data you provide during registration (name, date of birth, gender, phone number, profile photo), fitness data obtained through health integrations (steps, calories, distance), usage data (leaderboard position, Season Pass progress, donations), and device and technical data (device type, operating system, app version).
8.3 Third-Party Integrations
The App integrates with Apple Health, Google Fit, and Samsung Health. By connecting these services, you authorise the transfer of relevant health data to the App. Your use of these third-party services is subject to their own terms of service and privacy policies.
8.4 Push Notifications
With your permission, we may send you push notifications and WhatsApp messages relating to your activity, community goals, mascot updates, and promotions. You may withdraw this permission at any time through your device settings.
8.5 Data Retention
We retain your personal data for as long as your account is active or as required to provide our services. Upon account deletion, we will delete your personal data in accordance with applicable law, except where retention is required for legal or regulatory purposes.
9. Intellectual Property
All intellectual property rights in and to the App, including but not limited to software, design, logos, mascot characters, graphics, text, and Content, are owned by or licensed to SIA Dosty. Nothing in these Terms grants you any right, title, or interest in such intellectual property.
You are granted a limited, non-exclusive, non-transferable, revocable licence to install and use the App on your personal device solely for your personal, non-commercial use in accordance with these Terms. This licence terminates immediately upon termination of your account or these Terms.
10. Third-Party Links and Services
The App may contain links to third-party websites or services, including Partner Offers. These links are provided for your convenience only. The Company has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. Your interactions with third parties are solely between you and the relevant third party.
11. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that: (a) the App will be available uninterrupted or error-free; (b) step data or fitness metrics will be accurate; (c) Partner Offers will be available or valid; or (d) community donation goals will be achieved.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY AND ITS DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP.
In no event shall the Company's total aggregate liability to you for all claims arising under or related to these Terms or the App exceed the total amount paid by you to the Company in the twelve (12) months preceding the event giving rise to such liability, or AZN 10 (ten Azerbaijani manats) if no such payments have been made.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential damages; in such jurisdictions, liability is limited to the fullest extent permitted by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless the Company and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any fraudulent manipulation of step data.
14. Term and Termination
14.1 Term
These Terms remain in effect for as long as you use the App or maintain an account.
14.2 Termination by You
You may delete your account at any time through the App's settings. Deletion of your account constitutes termination of these Terms. Any earned Coins, Season Pass progress, and leaderboard data will be permanently deleted and cannot be recovered.
14.3 Termination by Us
We reserve the right to block, suspend, or permanently delete your account and access to the App at any time, with or without prior notice, at our sole discretion, including but not limited to where we reasonably believe that: (a) you have violated any provision of these Terms or our in-App policies; (b) your conduct negatively affects other users, the integrity of the App, or the reputation of the Company; (c) you have engaged in fraudulent, abusive, or manipulative activity; (d) your actions interfere with the operation, security, or fairness of any App feature; or (e) such action is required by law or a competent authority. Blocked or deleted accounts will lose all associated data, including Coins, Season Pass progress, and leaderboard standing, with no entitlement to compensation or refund except where required by applicable law.
14.4 Effect of Termination
Upon termination, the licence granted to you under these Terms will immediately cease. Clauses that by their nature should survive termination (including Sections 9, 11, 12, 13, 15, and 16) will remain in force.
15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of Latvia, without regard to its conflict of law principles.
Any dispute arising out of or in connection with these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If not resolved within 30 days, the dispute shall be submitted to the exclusive jurisdiction of the competent courts of Latvia.
Notwithstanding the above, the Company acknowledges that users in Azerbaijan may have rights under local consumer protection laws that cannot be excluded by agreement. Nothing in these Terms limits any such statutory rights.
16. Changes to These Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you via the App, push notification, or email at least 14 days before the changes take effect. Continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.
17. General Provisions
17.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the App and supersede all prior agreements, representations, and understandings.
17.2 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
17.3 Waiver
The failure of the Company to enforce any provision of these Terms shall not constitute a waiver of future enforcement of that provision.
17.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms to a successor entity in connection with a merger, acquisition, or sale of assets.
17.5 Force Majeure
The Company shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, war, civil unrest, governmental actions, or internet service disruptions.
17.6 Language
These Terms are provided in English. In the event of any inconsistency between the English version and any translation, the English version shall prevail.
